Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at mylandalytics.com, your LandAlytics account, and the products you sign in to with it, including FieldWize and Leaf Scan (together, the "Services"), operated by LandAlytics LLC ("LandAlytics," "we," "us," or "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

• You must be at least 18 years old and able to form a binding contract.
• One LandAlytics account signs you in to each of our products. An account does not by itself give you access to any product; access depends on your subscription, your organization, and the people who invite you.
• You are responsible for the accuracy of the information you provide, for keeping your sign-in methods secure, and for all activity under your account. Tell us promptly about any unauthorized use.
• If you sign in with Google, your use of your Google account is also subject to Google's terms.

2. The Services

FieldWize provides farm management and agricultural decision-support tools for farmers, agronomists, and agricultural cooperatives, including field records, agronomic recommendations, an AI assistant, irrigation and input planning, notifications, and coordination of input orders. Leaf Scan turns plant tissue scans into maps and reports. We may add, change, or discontinue features.

4. Orders through cooperatives

FieldWize may let you request orders for agricultural inputs that are priced, fulfilled, delivered, and billed by a cooperative or other supplier. LandAlytics coordinates those requests and is not the seller of those products, and we do not process payment for them. Pricing, availability, substitutions, delivery, and payment are set by the cooperative or supplier, and your purchase is subject to their terms.

5. Subscriptions and fees

Some Services require a paid subscription. The price, billing period, renewal, and cancellation terms are presented when you subscribe, and form part of these Terms. Fees are charged to the payment method you provide. Refunds are as stated at purchase or as required by law.

6. Acceptable use

You agree not to:

• Use the Services in violation of any law or regulation.
• Access another person's account or data without authorization.
• Interfere with or disrupt the Services, or attempt to gain unauthorized access to them or related systems.
• Upload malicious code, or use the Services to send unlawful or unsolicited messages.
• Reverse engineer, copy, or resell the Services except as permitted by law.

7. Text messaging program

By providing your mobile number and opting in, you agree to receive recurring automated text messages related to your account and operations, such as account alerts, recommendation and irrigation advisories, and order updates. Consent is not a condition of any purchase.

• Message frequency varies with your account activity.
• Message and data rates may apply.
• Text STOP to cancel at any time. After you send STOP, we will send one confirmation and then stop; text START to opt back in.
• Text HELP for help, or contact info@mylandalytics.com.
• Carriers are not liable for delayed or undelivered messages.

How we handle mobile information is described in our Privacy Policy. We do not sell or share mobile opt-in or consent data with third parties for their marketing purposes.

8. Your data and our property

You own the data you submit to the Services ("Your Data"). You grant us the rights needed to host, process, and display Your Data to operate and improve the Services, and to provide it to the people you choose to work with through them. You can export your farm data from FieldWize.

The Services, including their software, content, and trademarks, are owned by LandAlytics or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes.

9. Third-party services

The Services rely on third-party providers, for example for sign-in, hosting, weather and imagery data, AI processing, and message delivery. Your use of an integration may be subject to the third party's terms, and we are not responsible for third-party services.

10. Disclaimer of warranties

The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any recommendation, reading, or report will produce a particular result.

11. Limitation of liability

To the maximum extent permitted by law, LandAlytics and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, crops, yield, or data, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amounts you paid us for the Services in the twelve (12) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless LandAlytics and its affiliates from any claims, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Services, Your Data, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or if necessary to protect the Services or other users. Provisions that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts serving Bingham County, Idaho, and you consent to their jurisdiction, except where prohibited by law.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continuing to use the Services after a change takes effect means you accept the updated Terms.
